This English version is provided for convenience. If there is any difference between this version and the Vietnamese original, the Vietnamese version prevails.

1. Introduction

– Welcome to thomore.vn – an e-commerce website set up and owned by THƠMORE COMPANY LIMITED (CÔNG TY TNHH THƠMORE) (hereinafter Thơmore).

2. Terms of Use

Whenever you visit the website thomore.vn, whether as a guest or as a registered member, please read these terms of use carefully. We reserve the right to change, amend, add to or remove any part of these Terms of Use at any time. Changes take effect as soon as they are posted on the website thomore.vn, without prior notice, and you are responsible for checking the website thomore.vn regularly so that you stay up to date with the information posted. Your continued use of thomore.vn after such changes are posted means that you accept the amended Terms and Conditions.

3. Scope and Guidance on Use

– These Terms and Conditions apply to customers who:
+ Order products sold on thomore.vn;
+ Wish to have products delivered to locations covered by the delivery policy published on thomore.vn.
– For the purposes of these Terms and Conditions, customers include:
+ Any individual with full civil act capacity, aged 15 or over, who has the assets to carry out a purchase, or who is supervised by a parent or lawful guardian.
+ Any organisation lawfully established and operating under the laws of Vietnam.
– Using any content of this website for commercial purposes, or in the name of any third party, without the written permission of Thơmore is strictly prohibited.
– When registering an account, you must provide accurate information about yourself and update it whenever anything changes, and you are responsible for keeping your account and login password secure. If your account is accessed without authorisation, you must notify us immediately so that we can deal with it. Thơmore accepts no liability for any damage or loss arising from your failure to comply with these rules.

4. Formation of the Contract

– Product information posted on thomore.vn shall under no circumstances be understood as an offer by Thơmore to the Customer to enter into a contract. A contract is formed and takes effect only from the moment the Customer’s order is accepted in one of the following 02 ways: a notice sent to the email address provided by the Customer, or a text message or phone call from Thơmore to the Customer’s phone number confirming that the order has been processed successfully.
– If you wish to cancel an order (where applicable), you must follow the rules of thomore.vn published in the Returns and Refund Policy. An order may be cancelled in part or in full as confirmed by the Customer with the Customer Care team. Thơmore has the right to cancel a Customer’s order in certain cases, as set out in the Delivery Policy. In that case, the amount the Customer has paid for the cancelled part of the order will be refunded to you in accordance with the applicable rules.

– To ensure fairness and protect the interests of Customers who are end consumers, Thơmore has the right to apply restrictive conditions when running promotional programmes: no limit, a limit on the maximum quantity of products one Customer may buy in each promotional programme, a limit on the purpose of purchase (for personal consumption only, not for business or resale…), or other limits (if any) set out in detail in each promotional programme. These restrictive conditions are hereinafter referred to as the Promotion Policy.
Accordingly, Thơmore has the right not to confirm, to refuse or cancel, or to recover products already delivered under, any order that breaches any part of the Promotion Policy.
– Thơmore has the right not to confirm, to refuse or cancel, or to recover products already delivered under, a Customer’s order in certain other cases at Thơmore‘s discretion, without notifying the Customer.

5. Placing and Confirming Orders

– When you place an order on the website thomore.vn, we will receive it and immediately send you an order number. The Customer then needs to complete one further step: Order Confirmation. Thơmore only confirms an order when the order request meets the order fulfilment criteria of thomore.vn.
– For your order to be confirmed quickly, please provide complete and accurate delivery information, and the information required by the terms and conditions of any promotional programme (if any) in which you are taking part.

6. Order Value and Payment Methods

– Product prices on thomore.vn may or may not include value added tax (VAT). In all cases, product prices do not include shipping costs. Shipping costs are set out in the Delivery Policy published on the website.
– The Customer pays the order value as set out in the Payment Policy. Clicking the “Checkout” button to proceed with payment for an order means that the Customer confirms having carefully reviewed the order details and agrees to the Terms and Conditions applicable to that purchase.
– thomore.vn accepts payment by bank transfer or by scanning a VietQR code into Thơmore’s bank account.
– However, to keep your payment safe, for orders worth more than 1 million VND, thomore.vn only accepts prepayment by: bank transfer or scanning a VietQR code.
– For payment security, please note:
+ Only make online payments in the window you are redirected to from thomore.vn;
+ Use and keep your cards (credit cards, ATM cards, shopping cards…) and your card/account details with care;
+ In all cases, for international credit/debit cards, please do not disclose the CVV/CVS/CSC number (the three-digit security code printed on the back of the card), so as to keep your card details secure.

7. Discount Codes and Promotional Programmes

– To bring more benefits to Customers, Thơmore regularly runs promotional programmes and special discounts. However, to ensure fairness to Customers who are end consumers, the rules and limiting conditions of each programme will be updated on the promotions page and may be changed without prior notice.
– A discount code is a form of discount that Thơmore offers to customers; it may reduce part or all of the order value.
– Only one (01) discount code may be applied per order. You will receive the terms and conditions of use together with the discount code.
– Thơmore has the right to refuse, without prior notice, any order using a discount code that does not meet its terms and conditions. In this case, the discount code will not be reissued. In addition, Thơmore has the right to refuse to extend codes that have expired, codes whose value has not been fully used, or in cases where the Customer unilaterally stops an order.

8. Shipping and Delivery

– Products will be delivered to the address the Customer provides in the order, within the time set out in the Delivery Policy, or at a time requested by the Customer provided that it is consistent with that policy.
– If you wish to change the delivery address, please call the Customer Care team again with the recipient’s full name, contact phone number and the new delivery address.
– The recipient must check the condition of the products and sign the Delivery Note on receipt. Risk and ownership of the products pass to the Customer from the moment the recipient signs the Delivery Note. The Customer should keep the Delivery Note for reconciliation or to resolve any issues that may arise in relation to the products (if any).

9. Exchanges and Returns

Exchanges and returns are handled in accordance with the Returns Policy published on the website thomore.vn.

10. Information Security

– Thơmore always places great importance on information security and uses the best measures available to protect all Customer information. Information provided during payment is encrypted to keep it secure.
– You must not use any software, tool or other means to interfere with the system or alter its data structure. The website also strictly prohibits distributing, spreading or encouraging any activity aimed at interfering with, sabotaging or gaining unauthorised access to system data. Any individual or organisation in breach will be stripped of their rights and, where necessary, held legally liable.
– The security of Customer information is governed by the Data Security Policy in the Operating Regulations published on the website.

11. Complaints Handling

– For any question or complaint, including but not limited to the quality of goods/services, product delivery, the attitude of delivery staff, or product exchanges/returns,… the Customer may contact the Customer Care team on (028) 6675 6679 or send feedback to [email protected].
– Please provide the order number that thomore.vn confirmed to you by email. Thơmore’s Customer Care team will receive your request immediately and respond to you as soon as possible.
– Complaints arising from incorrect information entered by Thơmore:
The Customer is responsible for providing complete and accurate information when transacting on thomore.vn. If the Customer enters incorrect information and sends it to Thơmore, Thơmore has the right to refuse to carry out the transaction.
In addition, in all cases, the Customer has the right to unilaterally terminate the transaction if the Customer has taken the following steps:
+ Notified Thơmore of the cancellation of the transaction by phone on 028.6675.6679 or by sending a request to [email protected]
+ Returned the products received, without having used them or derived any benefit from them (in accordance with the Returns Policy).

12. Limitation of Liability

In all cases, Thơmore is not liable for any damage, loss or harm suffered by the Customer unless caused by Thơmore’s intentional fault. Thơmore’s liability to the Customer (if any) is limited to the value of the products the Customer purchased on thomore.vn.

13. General Provisions

– The rules referred to herein form an integral part of these Terms and Conditions.
– Thơmore and the Customer are responsible for performing all obligations set out in these Terms and Conditions.
– If any part of these Terms and Conditions is held by a competent authority to be invalid or unenforceable in whole or in part, the validity of the remaining provisions of these Terms and Conditions shall not be affected.
– These Terms and Conditions and all matters arising in the contractual relationship between Thơmore and the Customer shall be interpreted and governed by the laws of Vietnam. Any dispute or complaint arising from or relating to these Terms and Conditions shall be resolved through negotiation within thirty (30) days. If it cannot be resolved within 30 days, the dispute or complaint may be settled at a competent court.
